1. Introduction

Welcome to FashionKaam.com (the “Site”). These Terms & Conditions (“Terms”) govern your use of our Site and services, including directory listings, advertising packages, user accounts, content submissions and more (collectively “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Definitions

• “User” means any visitor, registrant, subscriber, consumer or other individual or entity accessing or using the Site or the Services.

• “Advertiser” means any business, brand, individual or entity that purchases listing services, advertising slots or promotional packages via our Site.

• “Content” means all text, images, video, audio, graphics, data, reviews, comments, uploads, or other material submitted or posted on the Site by Users or Advertisers.

• “Directory Services” means the listing, search, display, promotional, matchmaking or referral services offered by us on or via the Site.

• “You” or “Your” refers collectively to Users or Advertisers.

3. Accounts, Registration & Eligibility

• You must be at least 18 years old (or the legal age of majority in your jurisdiction) to register for an account and use certain Services.

• To engage in Advertiser services, you represent that you are duly authorised to act on behalf of your company/ brand (if applicable).

• You agree to provide accurate, current and complete registration information, and to maintain and promptly update your account information.

• You are responsible for maintaining confidentiality of your account credentials and for all activities under your account. We reserve the right to suspend or terminate your account if we believe your account is compromised or you violate these Terms.

4. Use of the Site & Services

• The Site and Services are provided for lawful purposes only. You agree not to use the Site to:

  • violate any applicable law or regulation (including data-protection laws, export controls, sanctions, anti-money-laundering laws);

  • infringe the rights of others (intellectual-property, privacy, publicity);

  • publish or transmit unlawful, harmful, defamatory, abusive, obscene, fraudulent, racist or otherwise objectionable content;

  • engage in data-harvesting, scraping, automated access, bots, or any other activity that imposes a large burden on our infrastructure;

  • attempt to gain unauthorised access to the Site or any systems or accounts.

• We grant you a limited, non-exclusive, non-transferable licence to access and use the Site and Content for your personal or business use (as applicable), as long as you comply with these Terms.

5. Advertisers & Listings

• Advertisers may purchase listing packages, featured placements, promotional services or subscriptions as described on the Site.

• All orders are subject to our acceptance, and we may decline or cancel listings or Accounts at our discretion (e.g., if content violates our policies).

• Advertisers must ensure that all information furnished (brand name, description, images, links, contact information) is accurate, complete and compliant with applicable laws (including consumer-protection, advertising standards).

• We do not guarantee any specific outcome (views, leads, conversions) from a listing unless explicitly stated in the service description.

• Advertiser is responsible for any third-party payments, fees, taxes (including GST, VAT), duties applicable in their jurisdiction.

6. Content & Intellectual Property

• You retain ownership of your Content, but by submitting Content you grant us a worldwide, royalty-free, non-exclusive, sublicensable licence to use, reproduce, modify, publish, distribute, display, translate and create derivative works from your Content for the operation, promotion and improvement of the Site.

• You warrant that you have all rights, permissions and licences necessary to submit your Content, and that your Content does not infringe any third-party rights or violate any law.

• We reserve the right to remove, suspend or refuse to display any Content at our discretion (for policy violation or other reason).

• The Site’s own branding, logos, design, software, database and compilation of Content are owned by us or our licensors and protected by applicable intellectual-property laws. You may not replicate, distribute, sell, adapt or publicly display Site Materials without our express consent.

7. Payments, Refunds & Cancellations

• Advertiser orders and other paid Services must be paid as specified in the order confirmation. All payments are non-refundable unless expressly provided in our Refund & Cancellation Policy (see separate policy).

• We may suspend or cancel services if payment is overdue or if you breach these Terms.

• Users paying for services via the Site must comply with our payment rules and refund policy.

• We may change fees or suspend pricing or services at our discretion; changes apply prospectively and not to past sold orders unless otherwise agreed.

8. Disclaimers & Limitation of Liability

• The Site and Services are provided “as is” and “as available” without any warranty of any kind. To the maximum extent permitted by law, we disclaim all express or implied warranties (including fitness for a particular purpose, merchantability, non-infringement).

• We do not guarantee continuous, uninterrupted or error-free access to the Site. We are not responsible for delays, failures or errors caused by events beyond our control (force majeure).

• In no event shall our aggregate liability exceed the amounts paid by you in the prior 12 months for the relevant service. We shall not be liable for any indirect, incidental, consequential, special or punitive damages, loss of profits, goodwill, data or business opportunities.

• Nothing in these Terms limits liability to the extent required by Indian law (such as the Consumer Protection Act) or other jurisdictional mandatory rights.

9. Indemnification

You agree to defend, indemnify and hold harmless us, our officers, directors, employees, agents and affiliates from and against any claim, liability, damage, loss, cost or expense (including reasonable legal fees) arising out of or in connection with:

• your violation of these Terms;

• your use of the Site or Services;

• your Content or your infringement of any third-party rights.

10. Termination & Suspension

• We may suspend or terminate your access to the Site or Services, with or without notice, if you breach these Terms or if required by law.

• On termination:

  • your right to access the Site ceases;

  • all licenses granted by us end;

  • you remain liable for obligations accrued prior to termination;

  • sections survival (e.g., indemnification, intellectual-property, disclaimers) continue.

• You may close your account by contacting us, subject to any outstanding obligations.

11. Privacy & Data Protection

Your Use of personal data is governed by our Privacy Policy. By using the Site you consent to the collection, processing, storage and transfer of your personal data as described in the Privacy Policy. We comply with applicable data-protection laws, including the Indian IT Act, 2000 and related rules, and global laws as applicable.

12. Third-Party Links & Services

• The Site may contain links to third-party websites or services. We do not control third-party sites and are not responsible for their content, practices or privacy policies.

• If you choose to use third-party services you do so at your own risk and you should review their terms and privacy policies.

13. Changes to Terms

We may modify these Terms at any time. When we do, we will update the “Last Updated” date and publish the revised Terms on the Site. Your continued use of the Site after changes constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, India. If you access the Site outside India, you agree that the substantive law of India applies but you may also have additional rights under local law.

15. Severability & Waiver

• If any provision of these Terms is found invalid, illegal or unenforceable by a competent authority, the remaining provisions will remain in full force and effect.

• Our failure to exercise or enforce any right or provision does not constitute a waiver of such right or provision in future.
